Silverman Thompson Wins Case on Appeal to Reinstate Client as Trustee

Silverman Thompson attorneys, in a joint effort of the commercial litigation and trust and estates groups, persuaded the Court of Special Appeals of Maryland to remove a court-appointed trustee who had been appointed as a replacement for the client. After considering a brief authored by trust and estates attorney Ryan McConnell and hearing oral argument by commercial litigation attorney Chris Mincher, the Court, in an opinion by Judge Deborah Eyler, held that—in a matter of first impression—the appointment of the trustee could be appealed. On the merits, the court found that the replacement of the client with another trustee had not properly followed the Maryland Rules. As a result of the decision, the client was reinstated as trustee and plans to sell assets in the trust were halted.
